The ESMF document was prepared with reference to Indonesian laws and regulations and World Bank policies on: (a) environmental and social protection, (b) land acquisition and resettlement, and (c) protection for Indigenous Peoples. The ESMF should be used as the main guideline for environmental and social management of P3TB activities for all stakeholders regardless of the source of funding.

Environmental and social management set out in the ESMF includes: (i) activity screening procedures; (ii) procedures for identifying the potential environmental and social impacts of each component;... show/hide more contents..

(iii) procedures and procedures for developing environmental and social impact management instruments; and (iv) mitigating potential negative impacts related to the environment, social, land acquisition, protection of Indigenous Peoples, health and community culture.

Basic Principles of ESMF Application

1. Every P3TB activity must avoid, and if this is not possible, must minimize the potential negative environmental and social impacts (including Indigenous Peoples) that could occur as a result of development activities, land acquisition and / or resettlement. Activities need to find alternative locations or designs to avoid and minimize potential environmental and social impacts. If the potential negative impacts cannot be avoided, P3TB activities must prepare a plan that can mitigate and manage these negative impacts and can maximize the potential positive impacts;

2. Every activity must provide benefits, better lives and livelihoods for the people involved and affected. P3TB must ensure that the lives and livelihoods of affected people do not get worse as a result of program activities;

3. P3TB will not fund activities that are included in the list of exceptions as follows:

a. Activities that result in significant conversion or degradation of natural habitats including terrestrial, coastal and marine ecosystems, or activities that have conservation and / or environmental benefits that do not exceed the potential for loss, loss and / or require land acquisition and / or resettlement;

b. Coral mining activities (whether living or dead);

c. Large-scale construction activities that will result in significant negative environmental and social impacts, fatal and irreversible damage;

d. Any activity that might create a significant negative impact on the tribe or Indigenous Peoples in a village and / or in the surrounding villages activities or activities that are not acceptable to a tribe or Indigenous Peoples;

e. Activities that can remove or destroy cultural assets, including places with unique archaeological (prehistoric), palaeological, historical, religious, cultural and natural values;

f. Activities that do not respect traditional knowledge, indigenous cultural values ??and local communities with reference to the rights of Indigenous Peoples;

g. Activities that violate human rights include gender discrimination and child labor; and

h. Activities that produce or use materials or commodities that directly or indirectly damage public health, such as asbestos, narcotics, pesticides and others as regulated in Indonesian legislation.

4. Environmental and social management, land acquisition and resettlement, and protection of Indigenous Peoples must be carried out based on the principles of fairness, transparency, participation and meaningful consultation. Meaningful consultations must involve relevant stakeholders, not limited to the Central and Local Governments, but also non-governmental organizations, academic institutions, observers and the general public. Meaningful consultation needs to be carried out by providing accurate, complete and provided information as early as possible before the consultation is carried out.

Environmental Management Principles

1. P3TB will not finance activities that do not have environmental permits in accordance with the types of activities to be carried out. The application process for an environmental permit begins with screening the types of activities based on Ministry of Environment regulations Number 5 of 2012 and Minister of Public Works Regulation Number 10 of 2008 as well as regional regulations related to environmental permits;

P3TB will not finance activities that are included in the list of prohibited activities, such as: (1) activities that produce hazardous waste and cannot be mitigated; (2) activities that will result in significant conversion or reduction of natural habitats, including but not limited to conservation forests, protected forests, protected natural habitats, mangroves and coral reefs; (3) activities that can reduce or destroy cultural conservation areas that are not only limited to artifacts and buildings, but also sites that are sanctified or have high spiritual value and intangible assets for the local community; and (4) activities that use illegal timber; and

3. Environmental management activities include the implementation of environmental management and monitoring as well as making reports on the implementation of environmental management and monitoring.

Principles of Management of Cultural Heritage Objects (CHO)

1. Efforts to preserve CHO are aimed at maintaining its physical form which includes shape, size, color and function so that it is closer to its original state;

2. P3TB supports efforts to preserve cultural heritage. If there are indications of potential negative impacts on cultural heritage objects, the P3TB identifies appropriate measures to avoid or reduce these impacts. Steps that can be taken from documentation to rescue and protection of CHO sites as regulated in the ESMF;

3. Inventory of CHO must be carried out by collecting data and facts of BCB for planning its preservation and utilization. The scope of the CHO inventory includes a survey of the status and physical condition, human resources, and social conditions of the surrounding community. The purpose of the CHO inventory is to obtain data that will be processed into information used as material for program planning;

4. It is necessary to conduct a study of existing or future plans to identify activities that have the potential to have an impact (positive or negative) on CHO and to ensure that these activities do not harm CHO. Every activity that is identified as having a negative impact, must ensure that a mitigation plan has been prepared; and

5. If a CHO is found during an activity implementation, it is necessary to carry out special procedures, namely: (i) to stop physical activities at that location; (ii) delineation and fencing of CHO found so as not to be affected by ongoing activities; (iii) contact the relevant authorities; (iv) further investigating the found CHO, and (v) applying the ESMF procedure related to the new CHO findings.

Principles of Land Acquisition and Resettlement

1. Activities that impact land acquisition and resettlement should be avoided where possible, or minimized by exploring alternative physical investment designs and technical approaches;

2. If it is not possible to avoid land acquisition and / or resettlement, land acquisition and / or resettlement activities must be carried out with a sustainable development approach, namely providing sufficient resources to enable project-affected people (PAPs) to benefit from development. PAPs should be consulted with meaningful opportunities for decision making, planning and implementation of land acquisition and resettlement programs;

3. PAPs must be assisted in efforts to improve their livelihoods and standard of living or at least to restore their livelihoods and level of life to those before land acquisition and resettlement was carried out, or to levels before the commencement of activities (whichever is higher);

4. PAPs must be given compensation for all assets affected by activities according to applicable regulations; and

5. The implementation of land acquisition and resettlement is monitored and evaluated by involving PAPs at every stage of activities up to the stage of their livelihood restoration program.

Principles of Protection of Indigenous Peoples

1. The general objective of the protection of Indigenous Peoples is to ensure that planning and implementation of activities accommodate the needs and interests of Indigenous Peoples and respect for the identity, dignity, human rights, livelihood systems of Indigenous Peoples, and the socio-cultural uniqueness of Indigenous Peoples, as defined by the Indigenous Peoples. alone;

2. The specific objectives of protection of Indigenous Peoples are: (i) to ensure that Indigenous Peoples receive social and economic benefits from activities in accordance with their aspirations and needs based on their social and cultural characteristics; (ii) prevent or minimize negative impacts on Indigenous Peoples, and if they cannot be prevented, develop and implement mitigation measures based on a meaningful consultation process, resulting in broad support from affected Indigenous Peoples without coercion; and (iii) maximizing the potential positive impacts of activities on Indigenous Peoples;

3. Every activity must protect the rights of Indigenous Peoples to participate in and fairly receive benefits from activities in accordance with their socio-cultural characteristics; and

4. Indigenous Peoples Plan must be prepared and implemented if an activity affects or impacts (positively or negatively) Indigenous Peoples.

Principles of Disaster Risk Management

1. The principle of reducing vulnerability and increasing capacity in the context of disaster risk reduction is applied to all P3TB activities. Therefore, a potential disaster risk analysis needs to be carried out in the planning stage;

2. Mainstreaming of disaster risk management in P3TB is carried out through: training, preparation of activity plans, DED, implementation of development, operations and maintenance, and institutional strengthening; a

3. .If a very high potential disaster risk is identified with a high probability of occurrence of a disaster, it is necessary to formulate a Contingency Plan and SOP for the hazard risk in each area followed by routine simulations. Guidelines can refer to Perka National Disaster Management Agency (BNPB) Number 24 of 2010 and collaborate with the local Regional Disaster Management Agency (BPBD).
